Terms and Conditions

Welcome to Acaid, an on-demand platform for purchasing air-conditioning repair products and booking air-conditioning installation, repair, maintenance, and inspection services at your location.

These Terms and Conditions ("Terms") govern your access to and use of the Acaid mobile application (the "App"), owned and operated by GOTCHA COVERED HEATING AND AIR, INC. ("Company", "we", "us", or "our"). By downloading, accessing, or using the App, you agree to be legally bound by these Terms. If you do not agree, you must not use the App.


1. Eligibility

You must be at least eighteen (18) years old, or the age of legal majority in your jurisdiction, to use the App. By using the App, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

To access certain features of the App, you may be required to create an account.

The Company does not perform services, control service professionals, or guarantee service outcomes, repair results, product compatibility, or uninterrupted availability of the App.

4. Service Appointments and Access Requirements

Users are responsible for ensuring timely, safe, and reasonable access to the service location.

Delays, rescheduling, or cancellations caused by incorrect address information, lack of access, unsafe conditions, or User unavailability may result in additional fees or cancellation charges. Service timeframes provided through the App are estimates only and may vary due to technical, environmental, or operational factors.

5. Pricing, Payments, and Refunds

Prices for products and services are displayed in the App and may change at any time prior to confirmation.

All payments must be completed using approved in-App payment methods. The Company does not store full payment card details and is not responsible for errors, interruptions, or failures caused by third-party payment processors.

Refunds, if applicable, will be issued in accordance with the Company’s Refund Policy and applicable law.

Product descriptions, images, and specifications are provided for informational purposes only and may not be exhaustive.

Any warranties offered for products or services are provided solely by the applicable manufacturer, supplier, or service professional. The Company makes no warranties regarding product suitability, compatibility, or fitness for a particular purpose unless expressly stated in writing.

7. Account Deletion and Data Removal

i)You may request deletion of your account by submitting a request through the Contact Support form and selecting “Delete My Account.” Upon verification, your account and associated personal data will be permanently deleted in accordance with applicable laws and the Company’s Privacy Policy.

ii)You may delete your account at any time within the app by navigating to Settings and choosing the “Delete Account” option.

All content, software, trademarks, logos, and materials available through the App are owned by or licensed to the Company and are protected by intellectual property laws.

Subject to your compliance with these Terms, the Company grants you a limited, revocable, non-exclusive, non-transferable license to use the App for personal, lawful purposes only.

Your use of the App is governed by our Privacy Policy, which describes how we collect, use, and disclose your information. By using the App, you consent to such practices.

THE APP, PRODUCTS, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

The Company does not guarantee uninterrupted, secure, or error-free operation of the App and is not responsible for damages arising from service delays, service outcomes, or improper product use.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR PROPERTY, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP, PRODUCTS, OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses arising out of your use of the App, violation of these Terms, or interactions with service professionals.

14. Termination

The Company may suspend or terminate your account at any time, with or without notice, if you violate these Terms or engage in conduct that is unlawful, harmful, or inconsistent with the purpose of the App.

15. Governing Law and Dispute Resolution (Apple & Android Compliant)

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles.

Except where prohibited by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms, the App, or any products or services obtained through the App shall be resolved through binding individual arbitration, and not in a class, consolidated, or representative action.

Arbitration Opt-Out: You may opt out of arbitration by providing written notice to the Company within thirty (30) days of first accepting these Terms, using the contact information provided below. If you opt out, disputes will be resolved exclusively in a state or federal court of competent jurisdiction located in California.

Nothing in this section limits either party’s right to seek injunctive or equitable relief in court for misuse of intellectual property or unauthorized access to the App, as permitted by law.

16. Platform Requirements and Modifications

Use of the App is also subject to applicable third-party platform terms, including the Apple App Store and Google Play Store terms and policies. In the event of a conflict between such platform terms and these Terms, the applicable platform terms shall govern to the extent required.

The Company may modify these Terms at any time. Updated Terms will be posted in the App, and continued use of the App after such posting constitutes acceptance of the revised Terms.
